INTRODUCTION

Purpose.

The purpose of this Privacy Policy is to describe how Star Cloud Services, Inc. (“Star Cloud”, “we” or “us”) collects, uses and shares information about you and your company through our U.S. online interfaces (e.g., websites and mobile applications) owned and controlled by us, including www.starcloudservices.com (collectively referred to herein as the “Site”) , including personally identifiable information that we receive in the US from the European Union (”EU Personal Data”). If you are located in the EU, references in this Privacy Policy to “your information”, “your personal information” or similar terms is included within the definition of EU Personal Data.  Star Cloud recognizes that the EU has established strict protections regarding the handling of EU Personal Data, including requirements to provide adequate protection for EU Personal Data transferred outside of the EU.

Star Cloud complies with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries. Star Cloud has certified that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. For purposes of enforcing compliance with the Privacy Shield, Star Cloud is subject to the investigatory and enforcement authority of the US Federal Trade Commission.

Scope; Third Party Sites. This Privacy Policy applies only to information we collect at and through the Site. Our Site also contains links to third party sites that are not owned or controlled by StarCloud. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personal information.

  1. INFORMATION WE COLLECT AND WHY WE COLLECT IT


Information About You

Our service allows shoppers to gather and store receipts digitally from various retail stores (retailers). We collect information about you and your company, including name, address, telephone number, email address, hours of operation, names of staff, type of business, etc. In this regard we also collect information about shoppers’ activities and transactions with your company.

If you opt-in and provide your consent, we will share the information we have about you with certain third parties that can provide services to you, such as reports about how you are performing compared to this time last month (or last year), how you are performing compared to other retailers similar to you and how your sales have increased or decreased over a particular period of time. We will only share your information with these third parties if you opt-in through our online dashboard of third party service providers.

Information Collected Through Google Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of the Site. Google Analytics uses “cookies”, which are text files placed on your computer, to help the Site analyze how users use the site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on Site activity for Site operators and providing other services relating to Site activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. Information Collected Through Cookies and Similar Technologies

We and our service providers use cookies, web beacons, and other technologies to receive and store certain types of information whenever you interact with our Site through your computer or mobile device. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website.   1. HOW WE USE AND SHARE YOUR INFORMATION

To Provide Products, Services, and Information. As described above, we collect your information from you so that we can provide the services available at our Site. We may also send you information about our products and services, and new offerings. We may provide information to third party service providers that help us provide the Site and our services to you.

We use third party service providers (including our affiliate Star Micronics Co. Ltd and its subsidiaries) to provide our products and services, including to provide technical support, host our Site, send out email updates about the Site, provide marketing and advertising services for us, remove repetitive information from our user lists, and process payments. We use our affiliate Star Micronics Co. Ltd. to license and distribute the Shopper mobile app, and Star Micronics Co. Ltd. provide a driver to allow data to be shared with Star Cloud. Shopper data is stored and managed by Star Cloud. These service providers will have access to your information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.

Star Cloud will only process EU Personal Data in ways that are compatible with the purpose that Star Cloud collected it for, or for purposes the individual later authorizes. Before we use your EU Personal Data for a purpose that is materially different than the purpose we collected it for or that you later authorized, we will provide you with the opportunity to opt out. Star Cloud maintains reasonable procedures to help ensure that EU Personal Data is reliable for its intended use, accurate, complete, and current.

Where required by the Privacy Shield, we enter into written agreements with these third-party agents and service providers requiring them to provide the same level of protection the Privacy Shield requires and limiting their use of the data to the specified services provided on our behalf. We take reasonable and appropriate steps to ensure that third-party agents and service providers process EU Personal Data in accordance with our Privacy Shield obligations and to stop and remediate any unauthorized processing. Under certain circumstances, we may remain liable for the acts of our third-party agents or service providers who perform services on our behalf for their handling of EU Personal Data that we transfer to them.

Your Consent. In addition to the sharing described elsewhere in this Policy, we will share information with companies, organizations or individuals outside of StarCloud when we have your consent to do so.

 Disclosures for National Security or Law Enforcement. Under certain circumstances, we may be required to disclose your EU Personal Data in response to valid requests by public authorities, including to meet national security or law enforcement requirements.

 Legal Proceedings. We will share your information with third party companies, organizations or individuals outside of Star Cloud if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request.
  • Enforce applicable Terms of Use, including investigation of potential violations.
  • Detect, prevent, or otherwise address fraud, security or technical issues.
  • Protect against harm to the rights, property or safety of Star Cloud, our users, customers or the public as required or permitted by law.

 

Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

You may have the right to access the EU Personal Data that we hold about you and to request that we correct, amend, or delete it if it is inaccurate or processed in violation of the Privacy Shield. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access. We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your information, and to protect EU Personal Data from loss, misuse, unauthorized access, disclosure, alteration, or destruction in accordance with the Privacy Shield. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. In order to provide our products and services to you, we may send and store your personal information (also commonly referred to as personal data) outside of the European Economic Area (EEA), including to the United States. Accordingly, your personal information may be transferred outside of the country where you reside or are located, including to countries that may not or do not provide the same level of protection for your personal information.  We are committed to protecting the privacy and confidentiality of personal information when it is transferred. Where such transfers occur, we take appropriate steps to provide the same level of protection for the processing carried out in any such countries as within the EEA to the extent feasible under applicable law.
